By accessing the website, using our services, placing an order, or making a purchase, you acknowledge that you have read, understood, and agree to these Terms.
Kushie is an adult-use cannabis retail dispensary operating under New York State cannabis regulations and holds Adult-Use Retail Dispensary License OCM-RETL-26-000489.
1. Adult Use Only
Kushie products and services are available only to individuals who are 21 years of age or older.
Customers must present valid government-issued identification when required to verify their age and identity.
Kushie may refuse entry, an order, a sale, pickup, or delivery if a customer’s age or identity cannot be verified.
Identification may be requested before completing a cannabis purchase, including purchases initiated online or by telephone.
Customers may not purchase cannabis on behalf of anyone who is under 21 or otherwise prohibited from legally possessing cannabis.
Kushie reserves the right to refuse service whenever required by applicable law or regulations.
2. Legal and Responsible Use
Cannabis products sold by Kushie are intended for lawful adult use in accordance with applicable New York State and local laws and regulations.
Customers are responsible for possessing, transporting, storing, and using cannabis products lawfully after purchase.
Cannabis should be stored securely and kept away from children, individuals under 21, and pets.
Product information, educational materials, and employee recommendations are provided for general informational purposes and are not medical advice.
Customers should consult a qualified healthcare professional regarding questions about cannabis, medications, medical conditions, pregnancy, or other health-related concerns.
Customers are responsible for understanding the effects and risks associated with cannabis before consuming any product.
3. Website and Account Use
Information provided when placing an order must be accurate, complete, and current.
Customers are responsible for maintaining the security of any account credentials used to access Kushie services.
You may not use the website or ordering system for unlawful purposes, attempt unauthorized access, interfere with website operation, introduce malicious code, scrape or reproduce website content for unauthorized commercial purposes, or otherwise misuse the service.
Kushie may restrict or suspend access to the website or ordering services when reasonably necessary for security, fraud prevention, regulatory compliance, or operational reasons.
4. Orders and Acceptance
Submitting an online or telephone order constitutes a request to purchase products and does not guarantee that the order will be accepted.
An order is accepted only when Kushie confirms the order and the products are available for lawful sale and release.
Kushie may limit quantities, refuse, modify, or cancel an order because of inventory limitations, pricing or system errors, suspected fraud, age or identity verification issues, regulatory requirements, or other reasonable operational concerns.
Product availability displayed online may not always reflect real-time inventory.
If an accepted and paid order cannot be fulfilled, Kushie may remove the unavailable product and provide an appropriate refund or other remedy in accordance with applicable law and the payment method used.
5. Products, Product Information and Availability
Cannabis inventory is subject to availability and may change without notice.
Product names, photographs, descriptions, cannabinoid information, terpene information, package information, weights, and other product details are provided for informational purposes and may vary between products or production lots.
The product packaging and labeling supplied with the purchase should be relied upon for the product’s official labeling information.
Kushie may correct typographical errors, pricing errors, inventory errors, image errors, or inaccurate product descriptions and may update or remove products from the website without prior notice.
Product images may be representative and may not exactly match the packaging or appearance of the product received.
6. Pricing, Taxes and Payment
Prices are displayed in U.S. dollars unless otherwise stated.
Applicable New York State and local taxes, fees, delivery charges, and other applicable charges will be disclosed during the ordering or checkout process where applicable.
Accepted payment methods are those made available by Kushie at the time of purchase.
Payment authorization may be required before an order is prepared or released.
If an obvious pricing, tax, inventory, or system error occurs, Kushie may correct the error before completing the transaction and may provide the customer with the option to proceed with the corrected amount or cancel the affected item or order.
Kushie is not responsible for additional fees imposed by a customer’s financial institution or payment provider.
7. Pickup Orders
Pickup orders must be collected from the Kushie retail location at 104-39 Queens Blvd, Forest Hills, NY 11375, during the applicable store hours or pickup window communicated by Kushie.
The individual collecting the order must be 21 years of age or older and must provide valid identification when requested.
Kushie may require the customer’s identification, order confirmation, name, or other information reasonably necessary to verify the order and the customer’s eligibility to receive it.
Orders may not be released to individuals who cannot legally receive cannabis.
Orders that are not collected within the applicable hold period may be cancelled and returned to inventory.
Kushie may modify or cancel a pickup arrangement when required by inventory, operational, security, or regulatory considerations.
8. Delivery
If Kushie offers delivery, delivery availability is subject to applicable New York laws and regulations, active delivery areas, operating capacity, and the delivery options displayed at the time of ordering.
A person who is 21 years of age or older must be present to receive a cannabis delivery.
Valid government-issued identification may be required before a delivery is completed.
Cannabis deliveries will not be left unattended, placed in an unattended location, or released to an individual who cannot legally receive the order.
Kushie may refuse, delay, or reschedule a delivery if age or identity cannot be verified, the delivery location cannot be safely accessed, the recipient is unavailable, or completing the delivery would violate applicable law or regulations.
Additional delivery terms, minimum order requirements, delivery fees, geographic restrictions, and delivery windows may apply and will be disclosed when applicable.

10. Promotions, Discounts and Loyalty Programs
Promotions, discounts, coupons, loyalty benefits, and other offers are subject to their individual terms, eligibility requirements, expiration dates, inventory limitations, and applicable cannabis regulations.
Unless expressly stated otherwise, promotions may not be combined with other offers or applied retroactively to completed purchases.
Kushie may modify, suspend, or terminate a promotion when permitted by law because of inventory limitations, system errors, misuse, regulatory requirements, or operational reasons.
Promotional offers have no cash value unless otherwise required by applicable law.
Loyalty programs, if offered, may be subject to additional terms and conditions.
11. Returns, Exchanges, Defective Products and Recalls
Cannabis products are generally considered final sale except where a return, refund, exchange, replacement, or other remedy is required or permitted by applicable law or applicable regulatory requirements.
Customers should contact Kushie as soon as reasonably possible if they receive an incorrect, damaged, defective, or recalled product.
Customers should retain their receipt or order confirmation and, where applicable, the original packaging, product information, lot or batch information, and remaining product so that Kushie can properly evaluate the issue.
Customers should not alter, dispose of, or transfer a product that is the subject of a quality, safety, or recall concern unless instructed to do so by Kushie or an appropriate regulatory authority.
Refunds, exchanges, replacements, or other remedies may be evaluated on a case-by-case basis and may be subject to applicable New York cannabis laws and regulations.
Nothing in these Terms is intended to limit any consumer rights that cannot legally be waived or restricted.
12. Third-Party Services and Links
The Kushie website may contain links to or integrations with third-party services, including ordering platforms, payment providers, mapping services, analytics providers, communication tools, and other technology providers.
Third-party services may have their own terms, privacy policies, and requirements.
Kushie does not control third-party websites or services and is not responsible for their independent content, availability, policies, or practices, except to the extent responsibility cannot legally be excluded.
Your use of a third-party service may be subject to the terms and conditions of that provider.

15. Compliance with New York Cannabis Law
Kushie operates subject to the requirements of the New York State Office of Cannabis Management (OCM), the Cannabis Control Board, applicable New York State laws and regulations, and other applicable legal requirements.
Kushie may modify its services, ordering procedures, product availability, identification requirements, purchase limits, delivery procedures, or other business practices when necessary to comply with current or future legal or regulatory requirements.
Customers agree to comply with all applicable laws and regulations when using Kushie’s website, ordering services, and retail services.
Nothing in these Terms authorizes a customer to possess, consume, transport, distribute, or otherwise use cannabis in a manner prohibited by law.
16. Changes to These Terms
